Terms of Service

By accessing or using ProseCreator (the “Service”), operated by ProseCreator LTD (“we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you and ProseCreator LTD. You represent that you are at least 16 years of age and have the legal capacity to enter into these Terms.

ProseCreator is an AI-powered creative writing platform that provides:

• AI writing assistance with 57 specialized agent roles
• Living blueprints, character bibles, and plot thread tracking
• Knowledge graph memory for story continuity across 100,000+ words
• Multi-format export (EPUB, PDF, DOCX, screenplay, and more)
• Writers room collaboration with AI personas
• Market intelligence and publication tools
• Text-to-speech and audiobook production

Features may vary by subscription tier. We reserve the right to modify, suspend, or discontinue any part of the Service with reasonable notice.

To use the Service, you must create an account. You agree to:

• Provide accurate, current, and complete registration information.
• Maintain the security of your password and account credentials.
• Notify us immediately of any unauthorized use of your account.
• Accept responsibility for all activities that occur under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or engage in unauthorized activity.

4.1 Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not:

• Use the Service to generate content that is illegal, harmful, threatening, abusive, or harassing.
• Attempt to reverse-engineer, decompile, or extract source code from the Service.
• Interfere with or disrupt the Service’s infrastructure or other users’ access.
• Use automated systems (bots, scrapers) to access the Service without authorization.
• Resell, redistribute, or sublicense access to the Service.
• Use the Service to generate content that infringes third-party intellectual property rights.

4.2 Content Guidelines

While we support creative freedom, content must not violate applicable law. We reserve the right to remove content that violates these Terms or that we reasonably determine to be harmful.

5.1 Your Content

You retain full ownership of all creative content you create using ProseCreator. This includes stories, characters, world-building elements, blueprints, and all derivative works. We claim no ownership or license over your creative output.

5.2 AI-Generated Content

Content generated by our AI agents in response to your prompts and within your projects is considered your work product. You have full rights to publish, distribute, and commercialize such content.

5.3 Platform IP

The ProseCreator platform, including its software, design, trademarks, and documentation, is owned by ProseCreator LTD. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service during your subscription period.

5.4 No Training on Your Content

We do NOT use your creative content to train, fine-tune, or improve AI models. AI processing occurs in real-time to serve your requests and is not retained for training purposes.

6.1 Subscription Plans

The Service is available in the following tiers:

• Starter: 1 project, 50K words/month, 1 concurrent job.
• Professional: 5 projects, 200K words/month, 2 concurrent jobs.
• Enterprise: Unlimited projects, 1M words/month, 5 concurrent jobs.
• Studio: Unlimited everything, 10 concurrent jobs, priority support.

6.2 Billing

Subscriptions are billed monthly or annually in advance. Payments are processed securely through Stripe. You authorize recurring charges to your payment method.

6.3 Refunds

We offer a 14-day money-back guarantee for new subscriptions. After 14 days, refunds are provided at our discretion. Annual subscriptions may be eligible for a pro-rated refund if cancelled within the first 30 days.

6.4 Price Changes

We may adjust pricing with at least 30 days’ notice. Price changes apply at your next billing cycle. You may cancel before the change takes effect.

We commit to the following service levels:

• Starter/Professional: 99.5% monthly uptime.
• Enterprise/Studio: 99.9% monthly uptime with priority incident response.

Scheduled maintenance windows (announced at least 48 hours in advance) are excluded from uptime calculations. In the event of an SLA breach, affected Enterprise/Studio customers may request a service credit.

Your privacy is important to us. Please review our Privacy Policy for detailed information about how we collect, use, and protect your data.

Key commitments:

• Your creative content is encrypted at rest and in transit.
• We do not sell your personal information.
• We do not use your content for AI model training.
• You can export or delete your data at any time.
• Enterprise customers may request a Data Processing Agreement (DPA).

9.1 By You

You may cancel your subscription at any time through your account settings. Upon cancellation, you retain access until the end of your current billing period. You may export your content before your access expires.

9.2 By Us

We may suspend or terminate your account if you:

• Violate these Terms of Service.
• Engage in fraudulent or illegal activity.
• Fail to pay subscription fees after reasonable notice.

We will provide reasonable notice before termination except in cases of severe violations. Upon termination, we will provide a 30-day grace period for you to export your content.

9.3 Data Retention

After account deletion, we retain anonymized usage data for analytics purposes. Personal data and creative content are permanently deleted within 30 days of account closure, except where retention is required by law.

10.1 Service “As Is”

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

10.2 AI Limitations

AI-generated content may contain errors, inconsistencies, or biases. You are responsible for reviewing and editing all AI-generated content before publication. We do not guarantee the accuracy, originality, or quality of AI-generated output.

10.3 Limitation of Liability

To the maximum extent permitted by law, ProseCreator LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or creative work, arising from your use of the Service.

Our total liability for any claim arising from or related to these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim.

11.1 Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

11.2 Informal Resolution

Before filing any formal dispute, you agree to contact us at legal@prosecreator.com and attempt to resolve the dispute informally within 30 days.

11.3 Jurisdiction

Any disputes that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts of England and Wales.

We may modify these Terms at any time. Material changes will be communicated via email and/or a prominent notice on the platform at least 30 days before they take effect.

Your continued use of the Service after the effective date of changes constitutes acceptance of the revised Terms. If you do not agree with changes, you may cancel your subscription before the effective date.
